While I’m not a lawyer and can’t give legal advice, I want to help keep everyone informed of what’s being said. Here’s a quick summary of concerns they raised:
- Violation of Equality (Article 3 of the Constitution): The decree applies a stricter standard to people born abroad, even if they have an Italian parent, which could be seen as discriminatory.
- Retroactive Revocation of Citizenship: The law could remove citizenship from people who were considered Italian from birth under previous laws—something that contradicts previous rulings by Italy’s Constitutional Court.
- Violation of Legal Certainty: The decree appears to undermine settled expectations by changing the rules for people who thought they had acquired citizenship legally.
- Improper Use of Emergency Power: Decree-laws are meant for urgent situations, but critics argue this doesn’t meet the constitutional standard for emergency legislation.
They believe these issues could result in the law being struck down or amended by Parliament or the courts.
